전력산업에 대한 경쟁정책
본 보고서는 우리나라 전력산업의 주요 현황을 정리하고, 도매전력시장의 거래제도를 중심으로 하여 전력시장에 대한 경쟁정책의 성과를 평가하고, 전력시장의 효율을 제고할 수 있는 경쟁정책의 개선방안을 제시하고 있다. 또한 독점부문에 대한 요금규제와 전력산업 내 공기업의 지배구조에 존재하는 문제점을 분석하고 개선방안을 제시하고 있다.
우리나라는 2001년에 전력산업의 구조개편을 단행하였으나 판매단계의 경쟁 도입을 보류한 이후 전력산업이 매우 비정상적으로 운영되어 왔다. 도매전력시장은 구조개편 이후 다수의 민간 발전업체가 시장에 진입하여 경쟁시장으로 운영되고 있다. 그러나 진입제한의 완화와 다수 민간기업의 신규 진입에도 불구하고 에너지가격과 용량가격을 결정하는 거래제도의 구조적 문제점으로 인하여 도매시장에서 효과적인 경쟁이 이루어지지 못하고 있다. 도매시장에 효과적인 경쟁체제를 확립하는 데 실패한 가장 큰 원인은 단기간 사용 후 폐기할 목적으로 도입한 CBP제도를 근본적으로 바꾸지 않고 장기간 사용한 데 있다. 구조개편 이후 우리나라가 사용해 온 CBP 거래제도는 용량가격의 결정방식이 용량의 기회비용을 반영하지 못하고 있고, 에너지가격의 결정방식도 시장원리를 제대로 반영하지 못하고 있다. 특히 보정계수제도는 업체와 발전기종에 따라 에너지가격을 차등화함으로써 도매전력시장의 경쟁과 상충된다. 현행 거래제도는 전력산업에 효과적인 경쟁을 유도하는 데 실패하였고, 발전설비에 대한 투자의 효율성과 한전의 자회사인 발전업체의 효율적인 운영을 저해하는 결과를 초래하였다. 구조개편 이후 전력산업의 궁극적인 구조와 전력산업에 대한 정책의 불확실성이 장기화되면서 송전, 배전, 판매의 독점부문에 대한 규제와 전력산업 내 공기업의 지배구조도 시장원리에 부합하지 않는 현상이 심화되었다. 도매전력시장의 경쟁과 독점부문에 대한 규제를 구분하지 못하고 경쟁 도입 이후에도 정부가 전력업체의 이윤율을 정하는 일이 되풀이되었으며, 전력시장의 경쟁에서 가장 중요한 역할을 담당해야 할 한전의 발전자회사들과 한전에 대해 이윤동기를 제한함으로써 경쟁의 효과를 현저하게 감소시키는 결과를 초래하였다.
반면, 대부분의 선진국과 중진국들은 전력산업에 대한 이해 부족으로 경쟁 도입 초기에 겪었던 어려움을 극복하고 효과적인 경쟁체제를 정착시켰으며, 경쟁을 통해 전력설비와 예비력에 대한 투자와 급전에 관한 자원배분을 해결하고 있다. 우리나라의 전력시장에 존재하는 문제점들을 근본적으로 해결하고 전력시장의 효율을 높이기 위해서는 2005년 이후 불안정한 상태에 있는 전력산업구조에 관한 정책을 조속히 확정하고 도매전력시장에 유효경쟁체제를 도입하는 한편, 한전과 자회사들에 민간기업과 유사한 수준의 이윤동기와 경영자율을 허용하고 독점부문에 대한 규제제도도 유인성 규제제도로 전환해야 한다. 에너지가격에 대해서는 보정계수를 철폐하고 가격입찰제도로 전환해야 하며, 쌍방계약을 광범위하게 허용하는 것이 필요하다. 용량가격도 용량의 기회비용을 보다 정확하게 반영할 수 있고 설비투자에 대한 경쟁을 촉진할 수 있는 방식으로 바꾸어야 하며, PJM 등 미국의 동부 지방, 서호주 시장, 스페인 시장에서 사용하고 있는 방식을 참고하여 판매업체와 발전업체 간의 선도계약방식으로 변경하는 것이 필요하다. 기존에 건설된 발전기, 특히 기저발전기의 초과이윤 문제는 Vesting 계약을 통해 해결하는 것이 보정계수방식에 비해 훨씬 더 효율적이다.
This report describes the development of the electricity industry of Korea since its restructuring in 2001, analyzes the policies of the Korean government, focusing on competition policy for the wholesale electricity market, and proposes a set of recommendations that could potentially improve the efficiency of the industry. The most serious problem plaguing the wholesale electricity market is the inadequate rules for determining energy prices and the capacity price. Rules for determining energy prices kept changing since restructuring but have always been based on cost based. Further, the rules allowed energy prices to vary according to the ownership structure of a generation company and the fuel type. Capacity price is ostensibly based upon the concept of an equilibrium price in the spot market for capacities. But it is actually determined by a formula that relies on a particular PPA contract which has little to do with the opportunity cost of capacities in the spot market.
Current regulation of tariffs for transmission, distribution, and retail services imposed on KEPCO, which officially takes the form of rate of return regulation, also deviates considerably from a standard practice of rate of return regulation and causes inefficiency in both the monopoly parts and the wholesale market. It targets not only KEPCO but also its subsidiary gencos that compete with other gencos in the wholesale market and attempts to regulate the profitability of KEPCO and its gencos through a combination of regulation on retail tariff level and special discount factors that apply selectively to KEPCO’s gencos in the wholesale market. In addition, current policy on the governance of KEPCO and KEPCO’s gencos put serious restrictions on the profit incentives of them and allow the government a large degree of freedom in intervening in their management.
Based on the analysis of the structural problems and the comparison of the institutional arrangements governing electricity industry in other countries, this report proposes a set of alternative policies on the horizontal and vertical structures of the electricity industry of Korea, wholesale market rules, vesting contracts, incentive regulation of bottleneck facilities, and the governance of public enterprises in the electricity industry.
